DNA Software, Inc. (“DNA Software”, “we”, “us”, “our”) welcomes you to www.dnasoftware.com (the “Site”). The following terms (“Terms of Use”) govern your access to and use of the Site. Please review these Terms of Use carefully. By accessing and using the Site, you agree to be bound by all the Terms of Use set forth herein.

DNA Software Content

DNA Software owns the content on the Site and owns the intellectual property rights in the data analysis tools which may be available via the Site.

DNA Software grants you a license to access and utilize the data analysis tools which shall be governed solely by DNA Software’s End User License Agreement (“EULA”). You will be asked to agree to the EULA when you set up an account.

Customer and Account

In order to use certain functions of our Site, you may be asked to complete an online registration form. In consideration of your use of the Site and the services provided on it, you agree to provide true, current, complete and accurate information as requested on any registration form to which this Site may direct you, and to update that registration information as soon as possible after any information on such registration form changes.

You may be asked to choose a password and/or user name. You alone are responsible for keeping that password and user name confidential, and for any and all activity that occurs on this Site under such password or user name. You agree to immediately notify DNA Software of any unauthorized use of your password or user name or any other breach of security.

Security

Visitors agree not to (a) upload any content to the Site, including text, images, software, sound recordings, and video, except where expressly requested by DNA Software; and (b) use the Site for any unlawful or improper purpose. DNA Software may monitor or investigate the activities of any visitor to the Site and may take any action it desires to manage the activity at the Site, including denying access privileges to any visitor.

No Warranty

DNA Software provides the content of the Site in connection with its marketing and communications efforts. Content is not provided for evaluation in connection with any due diligence as to a possible investment, merger, acquisition, or other strategic relationship. DNA Software makes no representation or warranty as to the accuracy or completeness of the information.

Disclaimer

In no event shall DNA Software be liable to any visitor for any indirect, special, exemplary, consequential, incidental or punitive damages; or for lost profits, lost revenues, lost business expectancy, or business interruption losses.

Privacy

Information we collect that is not personally-identifiable: We collect information that is not personally identifiable (meaning, anonymous information) regarding use of the Site, such as login information, computer-related information (browser type you used, your Internet Protocol address, last URL visited, social media platform access, and the date and time of day of your login). We may send a “cookie” or “pixel tag” to your computer which contains an identification number that is unique to the computer you are using. You may decline to provide such information to us and/or refuse cookies in your browser, although some of our features or services may not function properly as a result, and some services may not be available.

We use this anonymous information to enhance the visitor experience at the Site, to understand how our Site is used, to communicate with our visitors and customers about information and services relating to the Site, to investigate and verify proper conduct at the Site, and to monitor the security and integrity of the Site. Internally, we use data in the aggregate to analyze our business.

What we collect about you that is personally identifiable (“PI”) and how we use it: We collect information that you provide us and information generated when you use the Site. This information may include your name, email address and password. If we collect passwords we will store them on our server in encrypted form. If you lose your password, we will provide a means for you to change your password.

  • We use PI to email or to otherwise contact visitors to the Site, and to contact companies that are customers and potential customers of DNA Software. Visitors can opt out of receiving future emails and electronic communications.

  • We may disclose PI as required by law and/or in response to service of legal process, such as a court order, summons, subpoena, and the like.

  • We use PI to investigate and verify proper conduct at the Site, to monitor the security and integrity of the Site, and to monitor and improve the Site and DNA Software’s analytical tools.

  • We do not share or sell your PI with or to third parties other than those engaged in fulfillment of products or services promoted through the Site.

How you can access or change the PI that we have collected: If you have created an account with us in which we have stored PI, you can access your account, review the information that is stored, and revise or delete that information. You will need to email us a written request to delete your entire account.
